=========================================================== Stanley Supports Montrose Repeal Effort (Montrose, CO) On Saturday, September 15, Rick Stanley, Libertarian candidate for U.S. Senate from Colorado, attended Liberty Jam 2001. Sponsored by the Committee to Preserve Property Rights, the all-day musical extravaganza raised funds and rallied support for the ongoing effort to repeal the anti-smoking ordinance passed by a mere 32% of Montrose voters last April. When asked why he was there, Mr. Stanley replied, When the rights of one American are denied by a law enacted by a few for a special interest group, all Americans suffer. "The Constitution ought to protect us from local laws that contradict our Bill of Rights. Local governments must ensure that the laws they enact are constitutional. Mr. Stanley went on to explain that the anti-smoking ordinance, ostensibly designed to protect people's health, is actually a taking of private property rights protected by the 5th Amendment. "The city government in Montrose should keep its nose out of private business affairs. If JoJo Ping wants to let the customers in her restaurant smoke cigarettes, that is her free choice, and not the government's. "If people don't like the smoke they can buy their breakfast somewhere else. The customer also has a free choice of whether to frequent that establishment or not.
