Denver City Council Declares Resolution to Defend National and State Constitutions

(DENVER CO) Rick Stanley, U.S. Senate candidate for Colorado and the Libertarian Party made the following statement to the media after attending the Monday night, March 18, 2002, city council meeting for the City and County of Denver:

I was absolutely thrilled, as was the crowd of 200 plus in attendance of the affirmative vote by a 7 to 4 margin, by the Denver city council to declare a resolution that the City and County of Denver will defend the national and state constitutions.  Council members MacKenzie, Haynes, Wedgeworth, Barnes-Gelt, Ortega, Reynolds, and Foster each had rousing speeches defending the Bill of Rights as well as denouncing the recent revelation that the Denver police have kept over 3,000 files on individuals that were considered political activists.  I am on that list, and I demand that the entire list be released to the public immediately, so the citizens of Denver can judge whether these files are appropriate and whether the Denver Police Department has once again stepped over the line and violated the peoples’ trust.  Friday night, my wife and I were part of the memorial procession sponsored by Denver CopWatch and our group of 100 was followed for 15 blocks by the Denver police, that started on the 16th Street Mall and wound throughout downtown Denver.  This procession was to honor the list of murdered men at the hands of the Denver police in recent years (see media release dated March 13, 2002 entitled “Stanley to Join Denver CopWatch Memorial Procession”).

The city council of Denver has made a resolution defending the state and federal constitutions, and publicly stated that our civil rights and liberties are not to be violated in Denver by the police.  When will the City Attorney ask Judge Robert L. Patterson, at the Denver County court, to approve my motion to dismiss the weapons charge against me and recognize my right to keep and bear arms, 2nd Amendment, Bill of Rights and national constitution as well as the State of Colorado constitution, Article II, Section 13, which guarantees every person’s right to keep and bear arms in defense of person, home and property?  The Denver Revised Municipal Code chapter 38-117(b) which is the code number that the Denver police arrested me on December 15, 2001 below the State Capitol on the 210th birthday Bill of Rights rally, violates my civil rights outlined in both state and federal constitutions.

I am asking the Denver City Council, Mayor Webb, the City Attorney, and Judge Robert L. Patterson to defend the oath of office that each of them has sworn to uphold the national and state constitution by striking down this unconstitutional abomination, the Denver Revised Municipal Code chapter 38-117b, and declare Rick Stanley not guilty in his civil disobedience trial which was the only avenue left to Mr. Stanley to secure our constitutional rights against an unconstitutional government.  Resolution 13, Series of 2002, “must not be hollow words,” was the remark of many city council members, and must be a plea by that council which must be heeded.
