Colorado State Supreme Court Refuses to Hear Stanley Writ of Certiorari and Thereby Denying His State Constitutional Rights

SUBJECT: Colorado State Supreme Court Refuses to Hear Stanley Writ of Certiorari and Thereby Denying His State Constitutional Rights

Rick Stanley, Constitutional Activist and former 2002 US Senate Candidate, made the following statement to the media:

"My appeal to the Colorado State Supreme Court regarding my Denver gun case conviction for openly carrying a weapon on Dec. 15, 2002, has been refused by the Court. They REFUSE to hear this important constitutional rights case."

"The state constitution guarantees and protects the individual's right to keep and bear arms "openly" anywhere in the state of Colorado. The legislature and Governor Owens of Colorado, approved and signed SB-25 on March 18, 2003, which makes any ordinance, by any city in Colorado, which violates the individual state constitutional right to openly carry a weapon anywhere, a crime by that city."

"The state constitution statute, "allowing" cities to make ordinances has a provision in Section H that demands the city make "no ordinance" that violates a Colorado citizen's guaranteed and protected rights."

"This "new" law only says what the state constitution already said. I have six months of jail time in Denver and three months of jail time in Thornton, hanging over my head, for exercising my state constitutional guaranteed and protected rights. These courts in Denver and now the Colorado State Supreme court, refuse to honor Stanley's constitutional rights. Rights are not a privilege. What part of "shall not be infringed" do these judges not understand? Who the hell do they think they are? These courts are here to protect OUR RIGHTS, NOT DENY THEM. The courts are not here to throw people in jail for exercising their constitutional rights. The courts have told me in Denver that I have "no" constitutional rights in Denver."

"I have decided to take my case to the people of COLORADO and America. Beginning Thursday morning, May 24, 2003 from 7:00AM till 9:30AM, I will be picketing in front of the Colorado State Supreme court building with flyers explaining my conviction and appeal, and a LARGE six foot sandwich board sign in red, white and blue which will say "RICK STANLEY DEMANDS HIS CONSTITUTIONAL RIGHTS BE UPHELD AND HIS CONVICTION OVERTURNED BY THE DENVER AND COLORADO SUPREME COURT JUDGES THAT HAVE VIOLATED THEIR OATH OF OFFICE WITH THEIR TREASON AND COWARDICE!!!!" I will continue this picketing on TUESDAY May 29th at 7:00 AM to 9:30 AM each weekday, armed with my sign, flyers and a .357 Magnum Taurus pistol on my hip, loaded and openly displayed, at the corner of Lincoln and 14th Avenue, near the capitol to let America know of this treason by the JUDICIAL BRANCH of government in COLORADO. I will file an appeal with the Federal Court of Appeals in the next thirty days, but it is important for America to understand that I am no longer "ASKING" for my rights to be protected, guaranteed and upheld by the COWARDS of the JUDICIARY in COLORADO. I am DEMANDING it. If they DENY me and allow this conviction to stand, I will make my own DECLARATION OF INDEPENDENCE and declare my own personal war against the UNCONSTITUTIONAL government of DENVER, COLORADO and AMERICA. MY COUNTRY has been overthrown from within, in all branches and at all levels of government. The government EXISTS to facilitate the exercise of ALL OF OUR CONSTITUTIONAL RIGHTS. They have no other mandate from the American people. Without this mandate to stay within the boundaries of the US and State Constitutions, governments at all levels are committing TREASON against the people. This citizen of COLORADO is drawing the line in the dirt for all of AMERICA to see. I will not stand for this treason. Recently, a federal judge said that our American judiciary is irretrievably broken. She was correct, and with that statement the American people must end this tyranny and sham, of a MIRAGE of constitutional government. The lie ends with RICK STANLEY. The BUCK STOPS HERE AND NOW. This citizen will defend against this UNCONSTITUTIONAL ACTION by this government, with his life. This will not stand. Those who are not sheep in America, can make their own decision, whether to defend our Constitutions or not. I won't wait for the COWARDLY or UNCARING AMERICAN, any more. I refuse to stand by as my American brethren continue docily to do, and accept the tyranny of the POLICE STATE OF AMERICA. I refuse to accept that the premise for government authority in the form of CONSTITUTIONAL LAW is DEAD in AMERICA!!!"
