Rick Stanley Constitutional Activist and former US Senate Candidate for
the 2002 races, gave the following media release:
STANLEY EXERCISES HIS RIGHT...by Rick Stanley
The past two weeks, since March 18, 2003, when Governor Owens signed
into law the new SB-25 which affirms the State Constitution and our
right to openly carry on our person and in our vehicles in Colorado, and
specifically prohibits cities and counties from using Home rule to make
ordinances that violate that right, I have been exercising that right in
Denver and all over Colorado. As many of you know, I was arrested two
times in the past eighteen months for exactly that charge in planned
acts of civil disobedience in Denver and Thornton, who both had similar
ordinances denying a citizen the right to openly carry a weapon in
violation of the State Constitution. I did these acts to overturn the
ordinances and bring attention to the fact that the government was using
the jurisdiction of local laws and local courts to deny Americans the
right to keep and bear arms, in many different ways. I must still win
those two cases on appeal at the Colorado State supreme Court and Adams
County District Court, to remain out of jail on the Denver sentence of
six months, and the Thornton sentence of three months in jail. This
should make the case easier, now that the legislature has affirmed those
rights with SB-25, with a public rebuking of the Home rule ordinances by
the likes of Denver and Thornton. The Judicial branch should now follow
suit on my cases, but nothing is guaranteed in Colorado Courts,
including your Constitutional Rights, whether they be the State or
Federal Constitutions. I must win those cases because the SB-25 applies
only to March 18 and forward regarding court cases.
With the history all discussed, I will tell you of the present.
Exercising those rights around Colorado and particularly Denver has been
a pure delight. People have asked me why I am wearing a gun. Am I a
cop? What do I do for a living? The questions go on and on, but many
just ignore the fact that I am armed. I am not bothering or assaulting
anyone, except maybe their sensibilities carved into their mind by the
propaganda machine called the MEDIA. Each day from morning till night,
and everywhere I go, with the exception of school property, the courts
etc... I have worn my new .357 Magnum pistol. This was the replacement
for the .357 that Thornton stole from me when they illegally arrested me
last summer for openly carrying in Thornton at the Harvest Festival.
I have had only one person tell me that they were "uncomfortable" with
me wearing the pistol. It happened to be my first stop, wearing the
pistol to a customer's property. I took it off, and put it in my car,
as I wished to do business with him, and did so. Private property
owners can insist that you not wear it on their property if they wish,
and to comply with the law, we "gun toters" must comply. I could have
just left, but complied with his wishes. Yes, I discussed it with him,
but he "just feels uncomfortable". Hundreds of times since then,
including Vail art galleries, restaurants, bars, buses (Vail only),
Denver restaurants, bars, businesses, and on the streets of all cities
along the front range, everywhere I went, I openly wore my pistol, and
exercised the right I have fought so hard for the last eighteen months.
The fight continues.
Why am I writing this piece? To urge Americans all across the country
to exercise your protected and guaranteed right to keep and bear arms
OPENLY, because if you don't, the assaults on our 2nd Amendment Rights
will continue, and you will lose them. I write this opened piece in the
hope that one man's fight will embolden you to start defending your own
