This is the speech that Rick Stanley, Constitutional Activist, delivered at the Counter Attack 2003 Forum in Dallas held February 9th and hosted by David and Jennifer Rostcheck of Bridgepoint Training Institute.

This weekend forum was for training of activists across America for the Constitution.

"I want to thank David and Jennifer for inviting my wife and I, and for their efforts to spread the liberty and freedom message!"

"I have to ask myself, and this audience a question! Why am I here, and why would any of you be bothered with caring what I have to say? I believe I have the answer, but you folks will have to be the judge of that. Work with me here, folks."

"In today's world, the beginning of 2003, each of us, either has, or is beginning to realize, the encroachment of government in our lives to a point where the intended roles for Americans and American government have been reversed. The intended roles, as imagined by the forefathers, the framers of the Constitution, were to have been, "We the People" - MASTERS, and "American government" - SERVANT. "We the People" have failed our role as master and now, feel uncomfortable and cheated, as a servant to the master government. It is our fault, as apathy, media manipulation through carefully constructed events and propaganda, the human need to socialize and fit in with our peers, a society that praises and rewards politically correct, over truth and integrity, presides. We ask ourselves, how did this happen? My initial reaction, was to blame the previous generations to around the beginning of the 20th century. 1913, specifically, with the politicians in congress during Woodrow Wilson's administration, and their treacherous selling of our birthright, and America's future down the drain, with the Federal Reserve Act and the income tax.

I realized that each generation failed themselves and America's republic by trusting in government, because they loved America, and couldn't imagine that anyone, and certainly not our duly elected and trusted politicians, would sell us out!

The destruction of America's heritage of a republic, embodied in the protected and guaranteed God-given rights, of our U.S. Constitution and Declaration of Independence, has been done an inch at a time, at the behest of the controllers who have overthrown America from within. These men who now control America, by pulling the money strings through the international banks that comprise the bulk of the ownership of the Federal Reserve Corporation, plan on using the power of America and the United Nations, to implement their New World Order, to dominate the people of America and the world.

With that revelation to OVERLOAD my brain, along with running a multimillion dollar business in Denver, distributing fasteners and shop supplies to industry, raising three kids who are now 29, 21 and 19, the expansion of the family with spouses and a grandchild, trying to maintain a wonderful relationship with my wife, Pam, well I somehow managed to investigate other government infringements on our rights during the midst of an eighteen month long US Senate campaign for the 2002 election. What I discovered both infuriated and discouraged my will to fight the injustice and advancing tyranny upon the American people. However, I couldn't sit back and just pass judgment by my own decree, and then do nothing to stop it. The biggest single issue was the local advancing tyranny of gun ordinances preventing Americans from actually exercising their God-given and constitutionally protected and guaranteed right, to keep and bear their arms."

"On December 15, 2001, in Denver, at Veterans' Park, below the west steps of the Colorado state capitol, on the 210th birthday of the Bill of Rights, in front of a 250 person crowd, I was arrested after a twenty minute speech regarding our right to keep and bear arms by 20 heavily armed cops from the Denver SWAT Team, undercover investigation team, uniformed cops and mounted police, for actually exercising the right to keep and bear arms, openly in a holster at my hip. I felt the hypocrisy of the government's plan to use local ordinances to prevent America from actually exercising those 2nd amendment protected and guaranteed right to keep and bear arms, was a conspiracy from the highest, to lowest levels of government, encompassing the executive and legislative branches embracing verbally those rights, while using the local judicial branch through their embracement of the unconstitutional ordinances, as a criminal attempt to disarm America. In other words: LOCAL DISARAMAMENT, that our leaders nationally can wash their hands of. It has worked across the country.

New York, Chicago, Washington D.C., San Francisco, all have local ordinances not allowing even the ownership and keeping of arms in the city limits. Denver, California, and thousands of other cities across America that prevent Americans from bearing their arms, while they are still allowed to keep them in their homes, businesses, and sometimes in their cars, has disarmed this country."

"So now I am in jail. In jail, for the next twenty eight hours.

Lousy food - baloney sandwiches with hard bread, and little packets of ketchup in place of mayonnaise and mustard. Sitting next to me, was a bonus for anyone in jail, as they were the beneficiaries of my meals. I did eat the apple and drink the milk. Jail was not the goal. Obtaining standing was. Now wronged by the government. Arrested for being guilty of exercising, my constitutionally protected and guaranteed rights, under the fraud of color of law. All this, so that I could go through the court system, guilty verdict after guilty verdict, until either the State Supreme Court or the Federal Court of Appeals would strike down this unconstitutional ordinance. My cellmate was a young Mexican of about twenty four years old, here illegally, desperately trying to build a life in America, hampered with a heroine addiction, and the nastiest cough I had ever heard. He gave it to me, and I had the cough for two months. This young man took one look at me, twice his size, as I walked into the cell, and his eyes got bigger and bigger, he said to me "they took your shoes. Why did they take your shoes?." I growled at him "They must think I am dangerous."

His eyes continued to get even bigger at this point, when he said "Well, are you dangerous?" I asked him what his name was. "Manuel", I said, "You don't have anything to fear from me. I am not a danger to you."

"It's funny now, but before I was arrested, the two months in advance that I planned to do this act of civil disobedience, friends kept asking me, "Rick, aren't you worried about the jailhouse bubba, we have all heard about?" In this jail, at 240 pounds and 6ft 2inches, I was "bubba."

However, word quickly spread about the U.S. Senate candidate in jail, and the principled stand I was taking. Throughout the twenty eight hours of my jail time, my cell block mates were being released every so often, and each would call out: "Hey, Stanley, I'm voting for you and I will tell the people what you are doing!" Throughout my time in holding cell, after holding cell, sometimes as many as twenty men, in an 8 foot by 12 foot room, I talked, I educated, and I organized FUTURE resistors of the government tyranny, that they already well knew and understood. America is alive and well, unfortunately, America is in jail. 6.6 million felons in America in the system right now, another forty million ex-felons. The government has made felons of 46.6 million Americans, and over fifty percent of those are for personal responsibility crimes, that were not a crime one hundred years ago. Millions beyond that are incarcerated in city and county jails all across America, for smoking pot, ingesting a drug into their body, not having the correct permit on their vehicle, not having the correct permit to drive their vehicle, carrying a "dangerous" weapon. It's odd, but I gave an interview to "Westword Newspaper" in Denver this past week. The reporter asked me if the charge for a subsequent Thornton arrest after the Denver arrest, was for carrying a "dangerous" weapon. I asked her why the government and the media, insisted upon calling an inanimate object, dangerous. She thought a bit, and started laughing, and said I had a good point. I went on to say that her "dangerous" car, her "dangerous" kitchen knife she used at dinner, her "dangerous" baseball bat that she used at softball games, as well as her "dangerous" cell phone she used while driving, and "dangerous" pen she dropped on the floor of her "dangerous car" when she looked down to pick up the "dangerous" pen while driving through the red light caused the death of an innocent family - all were "dangerous" objects that we must make against the law very soon - to protect America. She got my drift." "Americans' unconstitutional government that has overthrown our country, is turning inanimate objects and personal responsibility issues into crimes. We have thought crimes now. And last year, thousands of Americans were arrested, their computers and belongings, stolen, because they were looking at porn from overseas websites, depicting children without their clothes. One idiot, was put in prison for writing in his diary, that he wanted to kill someone, anyone. He never did, but he thought about it. He is in prison to this day. Anyone ever said, "Ohhh, I could kill them for that!???" In the police state society of today's America, that will put you in jail!! The wrong person hears it, and you are cell block material. Who would do that? Children have been instrumental in the locking up of their parents for something our parents did weekly with us. Spanking or slapping will now create a jail stay for you. I have a client, forty eight years old, solid citizen, slapped his daughter who is a sassy sixteen year old, when she attacked him for closing the curtains in his own home, when she wanted them open, and he slapped her to bring some sense into her very inadequate brain. She called 911, and summoned the police, as her school has taught her. My client, my friend, was arrested, put in jail for a week, until he agreed to a plea bargain which was $1,000.00 fine, the week he had spent in jail already, classes for one year regarding anger management and child abuse, couldn't see his family for one full year by a judge's restraining order, and by the way, they stole all of his guns, and never returned them. Over $5,000.00 in legal fees, fines, and class costs, not to mention, no family for a year and for grins, give us your guns! America - Land of the Free!"

"Jail by inanimate object, computer, diary, and by children. Folks, I can go on and on. They are stealing America's birthright. Liberty and freedom destroyed by police state tactics backed up by judicial tyranny. How can I say that? Well now let's go back to my Denver gun case arrest.

My Denver gun trial came and went this past summer. Highlights included: a jury pool stacked with government employees and police. Seven of the first twelve jurors to be exact. From this group my eventual 6 person jury was seated. Five women and one man. For this court round, I had constitutional lawyer and libertarian, Paul Grant, as my attorney. Grant had provided to the judge all of the constitutional legislative, as well as judicial case law, that should have caused any judge to end the case on the spot with an acquittal. Well, of course the justice system doesn't work that way!! OATH OF OFFICE to defend the state and national constitutions by Judge Patterson - thrown out the window!!

This is my courtroom and "YOU WILL NOT MENTION THE CONSTITUTION AGAIN.""

"My lawyer, Paul Grant, has told me this would happen. Hell, I knew it would happen. It did! My cagey and crafty lawyer, drones on and during Voir Dire - questioning the prospective jurors, mentions the constitution again. Judge Patterson goes berserk: "Didn't you hear me Mr. Grant? YOU WILL NOT MENTION THE CONSTITUTION AGAIN - and if you do, I will impose sanctions upon you." So here I am sitting at the defense table - I'm smug. I'm calm! I'm so very cool!!! I know that my crafty lawyer will calmly and coolly - as per his client's wishes - he will stand up to this judge, wear him down, and justice will prevail.

WRONG! My lawyer caved. Folded like a napkin. Wimped out you might say.

I'm a Libertarian, although, after November 6th, I resigned as a Libertarian Party member. Mr. Grant did what I call a "Libertarian Act of Conscience."

He said he would stand up to this tyranny, and then he very meekly, didn't. He went through the motions of putting up a defense for an ordinance that has no defense except the Supreme Law of the Land - the U.S. Constitution. Oh - I forgot - the Colorado constitution as well. But those laws don't apply in the kingdom of Denver. They proudly proclaim home rule, as the Colorado constitution proudly gives Denver the right by charter, to make these ordinances. You see Denver government got to mention through the judge and the City Attorney, throughout the trial, anything in the constitution they wanted, but got to pick and choose what they wanted to use, while the defense could not. The constitutional amendment giving Denver the power to make ordinances? USE IT! The constitutional amendment allowing Stanley the guaranteed protection of exercising his right to keep and bear arms to protect his person: that's right - it goes beyond keep and bear arms - it says in defense of his home, person, and property! It say's Stanley's right is not to be called in question. And it says no person will stop me. Guess they forgot the corporate entity of Denver, who the Constitution says has Home Rule authority! Guess they also forgot section H, of that same amendment giving Denver the authority for Home Rule - which says that no ordinance can take away a constitutionally protected right that was in place before Home Rule. Busted. Busted again, and again. Doesn't matter. Denver judges know how to ignore anything they don't like. Like the superior Law. Every dirty trick in the book. Stanley guilty. Denver - one, justice - nothing. Six months in JAIL, $629.00 fine, seventy five hours of community service and one year probation. Oh, by the way, serve this sentence right away, by October 2002 and you can do thirty days at home instead of in jail. We will even give you the free use of an ankle bracelet during that time. Oh, you're going to appeal this? Okay - pay another $2500.00 for an appeal bond so your sentence is stayed during appeal. NEXT?

Round two: Denver District Court: "I appeal, no lawyer this time.

Been there, saw that done to me. Legal maneuvers, motions, petitions, hey I am kicking butt here, whippin' up on them. But they don't respond for six to eight months, no response. Then I get notice, that the District Court is dropping the appeal, not in my favor, because the City and therefore, Stanley, FAILED TO PROCEED. I am furious. People are telling me that they can't do that!! Yes, they can, and did. I knew this would happen as well, why get upset. Round three: Next stop, Colorado State Supreme court - my Writ of Cert is due on this upcoming Wednesday, February 12, 2003. I haven't even started it yet, but I will have the twenty pages or so done and turned in by the twelfth. Okay - stage left! Thornton, Colorado - June of 2002! Six months before the election for my U.S. Senate race. A very hot Saturday afternoon, I strap on my .357 Smith and Wesson, on my hip, and proceed to Thornton. I heard about a Thornton ordinance you see... Well, I'm all by myself, Damn, I forgot to tell Pam I was gonna do this. She went shopping or something. Who is gonna bail me out??? Minor detail - on a mission. Thornton Harvest Festival in the park. Families. Games. Booths. Food. Activities. What a day!! A perfect day to campaign in the park, hand out literature, meet and talk with the people!! Rick handing out literature, vote for me! Hey, I'm in the parking lot now, a cop car pulls up - "Afternoon officers my name is Rick Stanley, I'm running for the U.S. Senate - would you take a bit of literature to read on the next donut break??" "Oh, thanks fellas. Beautiful day isn't it??? Bye now." (waving) Looking across the parking lot now, feeling good. Met a couple of cops that know the constitution. Rockin' now!! I spot the Police and Fire Department Command Tent at the far end of the parking lot, on top of the hill overlooking more park and more Harvest Fest activities!! I boldly go into the command tent, fifteen officers and firemen. Hey, one good lookin' fire woman. "Hi my name is Rick Stanley, runnin' for U.S. Senate, I give flyers to everyone." They are reading the flyers, giving me odd looks. The sergeant, who was in charge says "wait a minute, you need a permit to hand out flyers!" "Oh, no sir, I say. Federal and state elections laws say that doesn't apply to candidates running for office." That is met with silence. The officer says, "Hey, now just a darn minute there. You're wearing a weapon there. We have an ordinance prohibiting that in Thornton." I smiled and said, "Officer, you and I both know that ordinance doesn't apply to me as the state constitution and national constitution clearly protects and guarantees every Colorado citizen the right to keep and bear arms. I am exercising that right to bring attention to all Americans that we must preserve that right by actually engaging in that right."

I look around, jaws were dropped all around the tent, I smiled, turned on my heel and left. Half hour goes by, I'm still handing out flyers, campaigning, enjoying the day in the park. I look up the hill and see fifteen police officers running down towards me, one hand on their hats, one hand on their holstered pistols. I should have had my video camera. Very, very funny!!! Keystone cops captured on film!! Whoops, not so funny anymore. I am up against a wall being frisked, hey - that's my gun! Not any more. Under arrest.

Cops take me back to the command tent. "You want to go to jail, or can we just issue a citation, and you agree to come to court? " "Well, I'll take the citation your honor, er I mean officer." An hour later, I'm on my way, handing out flyers for two more hours, no pistol in my holster. Cops eyeing me warily, the rest of the day. Went to court three times - Judge Rose presiding. "Sorry Judge, can't plead in your court, you have no jurisdiction!" "You see Judge, your oath, which I just put into the proceedings means nothing to you - you won't agree to a common law constitutional court." "The hell he says - "I'm entering a plea of NOT GUILTY! See you January 29th, and I will answer your Petition to Prove Jurisdiction, and be ready for trial, Mr. Stanley!"

With that said, my monthly trips to court in Thornton were over. Two months to prepare for gun case number two. Pro se, Stanley, aka no lawyer Stanley, battling City of Thornton. I whipped out a Petition demanding the City of Thornton, prove they had jurisdiction, a Motion to demand a jury of twelve, and a Motion demanding a fully informed jury. January 29th rolls around - Judge says "I read your Petitions and Motions, all denied." "Well Judge, what about all of my State Court citations, my Supreme Court citations, Section H of the Colorado Constitution, and Article II, Section 13 of the Colorado Constitution?" Judge ignores me, as if I wasn't even talking, discusses something else, and that's the reason. All denied! For the next two hours: "But Judge...denied. Ignore everything of any relevance to the case. Embrace everything the city brings up. Stanley - denied. Stanley - guilty. Ninety days in jail. Five hundred and twenty dollars in fines. Oh, you're appealing my ruling? $1500.00 appeal bond, sentence stayed for thirty days, while appeal is filed and bond is paid. With this done, all is stayed during the appeal process. Off to Adams County Court. I am definitely experienced now with this kangaroo court thing! What I didn't tell you is, the City Attorney for Thornton handed me a copy of the Colorado Supreme Court case "Trinen vs. City of Denver." Asked me if I was familiar with it. I was, I told him so. I blew it off. Nine pages long, this Trinen decision, I read the first five pages, while waiting for Judge Rose to come into trial. Last four pages can wait. Trinen's case was regarding the legality of Denver's "conceal carry permit - he lost, I am thinking I already know this, maybe I will read the balance later. Trial's over. Walking to the Durango, "Hey, Pam, I'm disgusted, why don't you drive?" I start reading the back four pages of the Trinen decision. The Colorado Supreme Court judge used the remaining four pages to discuss the Denver ordinance prohibiting open carry, of which Stanley was arrested for ten months earlier, in which my case and another fellow with me on December 15th, was arrested as well - are the only cases in Denver to have ever been tried in court because everyone pleads out, because the whole court trial, and appeal process, is too expensive, time consuming, and in most people's minds, JUST NOT WORTH IT. Well - not Stanley.

This is why Stanley was here in the first place - to expose this ordinance, expose the unconstitutional alliance with the judicial system and the city, and to appeal the ruling and overturn the ordinance in a higher court. Pam's driving - "PAM, you have got to hear this! This Colorado Supreme Court judge put in the Trinen vs. Denver, September 9, 2002 # 53P.3d 754 - a decision which said specifically Denver - "hey folks the 1972 Pillow vs. Lakewood City at 23, 501 p.2d, at 745 says you can't criminalize the simple act of carrying of firearms." Denver says you can have an affirmative defense, "if you can prove your life is being threatened." Only problem with that is, how and when do you know to be carrying a firearm, to protect yourself from being threatened? "Excuse me Mr. criminal - could you hold that thought, while I go get my firearm - you nasty man you - you just threatened me!" That is what Denver's ordinance basically says you must do, to be able to carry a weapon. Mr. Colorado Supreme Court judge says in this Trinen decision, says and I quote: "The structure of the ordinance precludes law- abiding and peaceful citizens from having a firearm available in the event they are suddenly and unexpectedly confronted with a life-threatening situation requiring the lawful use of deadly force in self-defense.

See & 18-1-704, C.R.S. 2001 (authorizing deadly physical force in self-defense, or in defense of another, without retreat when there is a reasonable belief that a lesser degree of force would be inadequate). These circumstances and others arise in the lives of law-abiding citizens, and, in my view, form a constitutionally protected basis for openly carrying a firearm on ones person or in a motor vehicle. Because I conclude these circumstances cannot be made subject to criminal sanctions and the ordinance does so, the ordinance is overbroad and therefore unconstitutional. I would reverse the trial court's holding to the contrary." "Whoops. Busted! Stanley will prevail in this matter at the Colorado Supreme Court. We don't need new legislation regarding guns in the Colorado legislature regarding the open carry of "dangerous" weapons. We already have guaranteed protected rights that lower courts are ignoring. We must demand these lower courts uphold the supreme law of Colorado: The Colorado Constitution and the U.S. Constitution."

Traitors Are Us! Where is all this leading?? Hopefully to a constitutional government restored in America! Why me? Hell, why not me? My country is dying. Dying a very slow death.

My kids and grandkids, are growing up into this police state death grip on their future, and their birthright of liberty and freedom.

Americans are being betrayed everyday by a government stealing their property: Guns, homes, bank accounts, computers, cars, boats, RVs, you name it. Because they have the power. OUR POWER. I have decided to withhold my power. No money for taxes, acts of civil disobedience to highlight my constitutional rights being violated by the color of law as administered by government thugs with guns. I will not participate in their permits for vehicles and driving privileges. I have notified them monthly in writing at the IRS, the President, the US Senate, the US House of Representatives and the US Supreme Court. My name is on the CIA Carnivore and Eschelon Key words list, that triggers law enforcement to record e-mails, and phone conversations when "Stanley" is mentioned, for later review. THEY KNOW MY NAME!! I have been on over two hundred radio programs, fifty TV news spots, hundreds of internet websites, thousands of internet mentions and conversations. I gave a speech below the national capitol, on a podium, on national web cast, in which I blasted the American government for its tyrannical police state ERECTION! They know my name. I am NOBODY. They know my name. I am every American. I will keep you appraised of what is going on across America, and the world, inside and very much inside information. You forward to your list, asking them to forward, and we wait! We wait for one American patriot, to have the stones, the guts to say to American government when they come for his or her property - to say "HELL NO!!" Create a standoff and put out the world for help, and make sure Stanley hears about it by phone, e-mail, someway, somehow! I will immediately put out the word by e-mail, by phone and my list will do the same - asking for Patriots to come - come armed to the teeth - locked and loaded. Prepared to fight for OUR AMERICA, embodied in the spirit of ONE American Patriot - surrounded by police, BATF, IRS, FBI. I will be there. Hundreds have committed to stand with me in defense of that one lone American Patriot. I will go, and they will go to wherever we must in America, to defend OUR property rights - OUR Constitution. The government thugs with guns, will have our American Patriot surrounded, cut off from the world, scared out of his wits. Prepared to die for what is right. The right to property. No government interference.

We will come, individually, and some in groups. We will park a block outside of their government perimeter, and we will wait for more Patriots. We will patrol the perimeter with scouts, we will learn their positions, we will see their weaknesses. We will grow, and when we are strong, and have sufficient numbers, we will blockade their perimeter, pick up our firearms and demand with bullhorns the surrender of all of the illegal/unconstitutional government thugs with weapons. If they attack OUR American Patriot or OUR FORCE, we will defend him and ourselves with a vengeance, I am absolutely sure they have never seen before. If this goes on long, OUR ranks will grow as other Patriots come to our aid. Once started, they cannot stop it. Americans will come from all across America, just as they did for the farmers at Klamath Falls last summer. This time, the media will be forced to cover - this time it will be big, very big! America will get its' long NEEDED WAKE UP CALL. I will be there. We will be there. America will prevail! The Second American Revolution will start at the next Lexington! Live Free or Die! Liberty in our Lifetime! Don't Tread on Me!
