Liberty Tree: A Patriot in need: Stanley committed
STANLEY NOTE: I am forwarding this the Stanley Scoop in the hope that they can help you with your very present need. I just committed $100.00 to Dick Simkanin's Legal Defense fund down in Texas. I will commit another $100.00 to you and I will send this out to the Stanley Scoop and a few other groups and hope some will contribute as well. I am getting spread thin by my own actions for Liberty and Freedom which in the last few years is up in the $60,000.00 range now. Legal fees, website, full time webmaster, printing fees are burdening my own situation. Nevertheless, like you I feel this effort is important, and I do it without regret. Well, some days I get a little down and regret it, and then I bounce back up. I have always been a positive thinker based upon reality. The reality of today's situation is intolerable as we all know. Many sit on the sidelines and grumble but do nothing, or very little. Those who are on the front line need help. I am not asking for help for myself, but I do come across others in the Patriot community that need your support folks. When they come for your property, yourselves, your children, your guns, we can be there for you. You in turn can be there for us. The government only understands force. DEFENSIVE FORCE is all that is left for Americans. They are afraid of that. That I am absolutely sure of. That is why I have formed this Mutual Defense Pact. You and America will need this to survive one day. All of us will. Our Constitutional rights are all that make us American. Nothing else does. The ideals in the Constitution and the Declaration of Independence is what separates us from the rest of the world. Help this couple with whatever you can now, commit to the Pact, and start defending yourselves and like minded Americans, not with an attaboy, but dollars and real committment to each other. Calm your fears and do not be like the Germans and Jews of Nazi Germany in the 30's and 40's. They watched until they it was too late, and then they watched their own destruction. Don't watch, do something.
By the way Stephen, there are others in Utah that have recently joined the Pact. Each person in each state has an obligation to recruit others in the state to make a QUICK RESPONSE FORCE close to your location to help out in a stand-off with government thugs who want to steal from you or arrest you for an unconstitutional and unlawful purpose. After your own State responds in the early hours of your need, the rest of America will respond state by state, coming to your aid. This THREAT will probably keep the government at bay in the future, but if not, the threat will become reality, and they will have the fury of committed Americans to deal with, who are armed, and ready to use force of arms to defend themselves and the other Mutual Defense Pact Miltiia members, in DEFENSE of you and yours. I have mentioned in this column many times, that if certain individuals across America had already committed to us, we would have committed to them, and been there for them in their hour of need. They didn't listen. They lost. They will continue to lose until each and every one understands that the government only respects force. They do not respect the rights detailed in the Constitution. They do not respect the SUPREME LAW OF THE LAND. Why should they respect any laws? In their mind, they shouldn't, they can just change the laws to make it more palatable for them, and that is what they have done, and will continue to do. Unless we stop them.

Dear Rick:
I, myself, am an unusually boring guy, but my g-g-g-g-grandfather was very interesting. They called him a patriot, even a Founding Father, because he did interesting things:
a.. Was a member and secretary of the Continental Congress.
b.. Inscribed the declaration of independence on parchment (after Tom
Jefferson composed it).
c.. Both composed and inscribed George Washington's commission as commander in
chief.
d.. Served on Washington's general staff.
e.. Was chief prosecutor at America's first treason trial for Benedict Arnold.
f.. Served as the first Secretary of State for the Commonwealth of
Pennsylvania.
g.. Worked with Ben Franklin (as "The Committee of Two") to draft talking
points for the Constitutional Convention of 1887. These "talking points" served
to stimulate debate on "The Virginia Plan", largely guided by the effort of
James Madison.
h.. After the Republic was founded, defended himself, his family, and his
property WITH PATRIOTIC PASSION: Once, when two "officials" from the new
Federal Government came to his door demanding performances from him which he
knew were unlawful to require of any Citizen, he severely beat those men with
his walking stick, finally knocking both of them from his front steps into the
street.
I'm very very proud of my grandpa. I'll NEVER be his equal. I'd be honored to
even shine his boots. Unfortunately, I'll never get that opportunity here in
mortality. Yet, from the time I was a pre-school boy, my Aunt Alma told me
wonderful true stories about our fascinating ancestor, Timothy Matlack. They
called him "The Fighting Quaker". From those childhood days in the mid 1950s
I developed a deep-in-the-heart pride for our Founding Fathers, and for the kind of America they envisioned and fashioned through untold personal risk and sacrifice. I also developed a deep sense of responsibility to do whatever I could to keep their sacred dreams and achievements alive and well in the America of our day. My wife, Denille, share a similar passion. Her ancestors played significant roles as pioneers of the American West.
To that end, both of us have done all we can to stoke the fires of American Constitutional Restoration. I've served in elected public office at the county level, and as an active advisory committee member for a U.S. Congressman. In those efforts I've invested many days and nights in the local court house and also in the nation's capitol. That was earlier in my life. Since then, both of us have invested our efforts in more "grass roots" patriotism. Earlier, Denille and I both had the naive notion that American politics still had something to do with the American Republic our Founders first created. Since then, we've learned a lot that is most distressing about American politics and the very literal subversion of our nation, its laws, and our individual freedoms, that the "Wizards of Washington" have brought upon us. Since then, we've oft times been ashamed that either of us was ever so deceived as to have placed our hopes in a government that repressively "reigns" over us, while treacherously pretending to constitutionally "represent" us.
Until the economy turned to ashes, I was in ground transportation management with a large 86-year-old tour coach company. Denille was also in management before losing her job. As the economy worsened, my company was laying off more and more front-line people until the "deep-waters of recession" rose to my level, and I became unemployed too. The situation was clear: America's old and trusty "Liberty Tree", which once produced the sweet fruits of unencumbered life, liberty, and property for all, had finally been transformed by a century of socialist-humanist perversion into a bastard plant. The resulting "New Tree" is only capable of producing the sour fruits of centralized international socialism--"Lemons" by any fair comparison to the blessings of liberty we once enjoyed.
Immediately, Denille and I decided to turn our attention to feeding America's trusty old "Liberty Tree". Perhaps we could turn some of its ill-begotten "International Lemons" into "Old-Fashioned American Lemonade". We came upon the idea that the blessings of liberty had left America, because the "foundations for American freedom" had not been aggressively "marketed" since the American Revolution. We reasoned that "The foundations for freedom lie deep in the character of moral, competent, independent INDIVIDUALS, who are broadly INFORMED and courageously ENGAGED, otherwise, the foundations for freedom lie nowhere at all."
>From this conviction, we decided that I would NOT seek another "job". Instead, we dedicated ourselves to the joint effort of creating educational products and a business plan for a freedom education website that would aggressively "MARKET" education and skills-development to systematically build the Foundations For Freedom within a rapidly expanding segment of the American population. Accordingly, we poured all of our efforts and all of our assets into this effort. In summary, the goal was to develop a sophisticated--yet easy to navigate--interactive website where browsers could visit in a "front lobby" filled with "poster-type" information pieces that would lead them to answer a single compelling question at a very personal level: "What's in freedom for ME, RIGHT NOW?" THEN, those who found sufficient PERSONAL VALUE in their answer to that question, could, at very reasonable costs paid on-line, enter the private "study rooms" of the website, and begin to rediscover and rebuild THEIR OWN Foundations For Freedom.
Great idea. We still believe in it 100%. We had plans to develop some very powerful information and strategies that people COULD USE immediately, to make A POSITIVE DIFFERENCE for themselves and our nation, incrementally. We had also developed a very strategic, aggressive, and proven internet marketing plan. To our knowledge, it was an approach never yet used in marketing the truths and tools of freedom. We still believe this approach could bring a rapid massive increase in awareness and support to the cause of "living in liberty". If the America of our Founders is to be resurrected and restored, we have little time left to do it. If this goal is achieved, the process that secures it will be nothing short of a "Second American Revolution"--albeit a peaceful one--and every element of effective mass-marketing will be required to gain the victory in the narrow window of time remaining.
In our efforts to help turn this tide, Denille and I DID develop some educational "product", and funded a lot of R & D for a top-notch interactive website and web-marketing. Unfortunately, the developmental task took more time and money than we could raise--even after working full-tilt for 14 months and selling almost every non-essential asset we had to get as far as we got. We have no regrets over our personal losses. Our only grief is that we were unable to make a difference for America, or at least give it a mighty go. It was our way of trying to "polish grandpa's boots", that our Nation could--perhaps--rise to it's former stride, abandoning our ruinous romp with international socialism to recover our national identity and solidarity: "One nation under God, with liberty and justice for all" TRUE Americans, and for them ALONE.
For now, Denille and I are just trying to persevere, choosing more limited battles, and waging them very carefully. Now, we keep busy with the "bread-and-butter" wars that are ever-erupting on our own front steps. These include earning a living--tough to do these days for old manager types in their 50s--and a focused effort to teach our kids "what's up in the world". We strive to help them understand their own personal responsibility to "stand up for what's right"--even if that means standing up against the unlawful acts of a treacherous government, when all you have left to stand in are your chains. To that end, we've tried to practice what we preach in the real world, so that our kids have decent examples, and we can hang on to whatever patriotic integrity individuals can still claim and clutch in the wake of America's increasingly unjust socialist bureaucracies.
In that area, you share a common concern with us: Unjust misapplication of U.S. Tax Laws.
Toward the end of 1998, we began to study Title 26 of the United States Code, and Title 26 of the Code of Federal Regulations. Investing substantial time and money in this "study", we concluded by mid 1999, that we were NOT subject to a liability for federal or state income tax UNDER THE LAW. Accordingly, I changed my "withholding status" to stop further federal and state income taxes from being deducted from my wages, and we did NOT file any tax returns for 1999. Furthermore, we have NOT filed or paid these taxes since then.
We also began to teach the kids what we had learned about the connections between international banking, government subjugation, and excessive unlawful taxation. Our intent was not to "evade" any lawful duty. Nor were we trying to "protest" the concept of necessary and lawful taxation. We STILL want to pay ALL taxes that are both justly necessary and lawfully binding upon us. We only wish to retain our lawful right to NOT pay ANY tax that is both injudicious or unnecessary for the nation, and lawfully non-binding upon us.
By June 2002, we had advanced our studies of taxation, and felt it would be
responsible, honest, and prudent to make two filings with the Secretary of the
Treasury AND the Commissioner of the IRS. This was done with the advice of a
patriot tax attorney, Ed Rivera, and the documents we filed were provided for us
by his wife, Liberty. Perhaps you know them; they're good people. The two
filings were
1.. Notice of Revocation of Signatures And Affidavit In Support Thereof
2.. Request for Status Determination
The purpose of the first document is to revoke all signatures on all existing
documents that were signed under duress and/or under the influence of officially
publicized government "misinformation", where such signing would have resulted
in the creation of "information returns" giving "presumptive evidence" that a
tax liability "may" exist.
The purpose of the second document has two parts: First, it present a summary of THE LAW establishing legitimate tax liability, and a summary of LAWFUL DUE PROCESS for determining, assessing, and collecting such taxes when lawfully due and payable. Second, it requests the IRS to determine the tax status of the person filing the document, requiring that point-by-point answers be given to each of the parameters of law and due process which would lawfully establish any liability or collection process that the IRS may "determine" UNDER THE LAW summarized in the document.
Each of these documents were filed as 60-day notices. Failure to answered either within 60 days would constitute default by the government, and forever establish the validity of our status as Citizens with no lawful liability to file income tax returns or to pay income tax.
Remember, we filed these documents on June 20, 2002, and obtained return receipts via U.S. Certified Mailings, documenting that both filings were received in a timely manner by the addressees. We received NO response from the Secretary, the Commissioner, or any other government employee on this matter within the stipulated response period.
Then, at the middle of last month--a year after our filings--I received two envelopes from the IRS. One was an "adjustment" of my taxes due for the year 1999, the second was a similar package for 2000. Together, these "adjustments" made a claim against me for all but $39,000. due and payable immediately for back taxes. Not only did the Service FAIL to respond with the default period stated in my notices to them; they also failed to respond to a single point of law, which clearly documented the absence of any legal obligation on my part to pay a tax. Nevertheless, I must have a response to the belated notices they served on me IN THEIR OFFICE on or before Wednesday, July 16, just a week from now.
I've been researching the appropriate response to effectively assert the truth of my just legal standing in this matter. I have found that the matter is unnecessarily, but strategically, complex, and that professional assistance is CRITICAL to create a solid self-defensive file that the Service will NOT be able to use against me. To build that file, an experienced constitutional advocate will be needed. Knowing the law is not enough. One must also have experience in the administrative process and how to "turn that process" to a personal strategic advantage. I have a basic understanding of the law, but NO experience in the administrative process and strategic maneuvering involved in the multiple volleys of notice-and-response that administrative proceedings entail.
On investigating who can provide the best time-tested help at the most affordable cost, last Friday I finally discovered the Save A Patriot Fellowship in Westminster, Maryland . They've been in continuous operation for 19 years, providing their members with comprehensive tax law self-study courses, tax strategies, and constitutional tax advocacy in both administrative and criminal tax proceedings. What's more, they have provided a self-insured financial loss protection plan for all members who can document financial loss due to government misapplication of the law. Their intent is to educate thoroughly, advocate aggressively, and compensate fairly, so that no patriot needs to retreat in fear for want of correct knowledge, a proven action plan, and preservation of essential resources
This is a phenomenal organization, made possible by 40 years of legal research, 19 years of effective constitutional advocacy for its members, and the mutual financial support of the members protecting each other against financial loss in the course of defending their lawful rights. Best of all, SAPF does NOT pursue the issues of unjust taxation in a vacuum. The organization is seeking to restore our Constitutional Republic in general by helping people comprehend "unlawful taxation" as a key tool being used by international socialists to plunder America's wide distribution of private property and personal wealth, while transforming the American Republic into a centralized socialist democracy. The driving destructive force of this "socializing" process is public and private debt, and inescapable personal dependence on an all-powerful centralized state. While tax justice is the Fellowship's area of specialty for reversing constitutional erosion, the Fellowship's training materials provide a broad knowledge of limited constitutional government and republican law that were created for a single purpose: To protect the life, liberty, and property of every Citizen, and otherwise leave each American ALONE, to prosper by his own capacity and effort in sovereign freedom.
I have had lengthy discussions with two representatives of this organization today. It appears that they have what it will take to bring my case to a successful conclusion for the least cost--$1100 less than the only other competent option I've found. In that process, I will also receive the kind of solid self-study materials AND administrative procedure experience to greatly enhance my own knowledge of tax law and also tax defense procedures.
Against all of these positive realities, we still have one negative to overcome: Because of our earlier investment of all we had in trying to develop Foundations For Freedom, coupled with the detriments of intermittent and meager employment since then, we have NO extra money to obtain ANY defense assistance at ANY cost.
Today, as I persistently sought alternative solutions that could be effective and attainable, I came upon your website. I quickly realized that there was no content or services there that could be immediately helpful to us in resolving my tax issue. But I also realized that there was an incredible fit between your mission and ours on the broader issues of constitutional restoration. The reason for the great detail of what's written above was to give you a fair chance to get a sense of our thoughts, efforts, and patriot passions. On that basis I'm hoping YOU can decide for yourself whether YOU also sense a solid fit between us.
If you do, here's an idea that may help us both in a small way IMMEDIATELY, and lay some ground-work on which we could build a larger more productive working relationship FOR THE LONG HAUL:

1.. Referral to someone who could immediately provide me with $2500 to fund my
defense through representation by SAPF against the IRS. OR
2.. Immediately provide me with $2500 from Stanley 2002 operating funds for
the same purpose.
I would not want you to consider this unless you truly felt that you could
obtain a full and fair exchange of value in this transaction. Our need is both
critical and acute, but we have nothing else to offer except a 13-year-old
pick-up truck. We have clear title to it, and it's well maintained, but we
can't get a loan on it, because I'm not presently employed. We also need to
keep the truck, because it's our only transportation.
Regarding your extended access to the SAPF Tax Educational Material, I would share it with you as soon as possible for as long as you need it, AFTER I obtained what I needed to understand my own present tax "situation" and our immediate needs for further tax planning.
Regarding writing, strategizing, or other project development , I could begin to assist you almost immediately.
If the items I've offered above to provide you with immediate value are not sufficient to secure the help I need, I would be open to consider any and all other ideas you may have in which my efforts could provide sufficient present value for you, or any other person you may know who could help. I am willing to consider any collaborative work or associations where I could assist you or any other benefactor in advancing the cause of freedom, free-enterprise, and constitutional restoration, thus returning full value for the assistance I'm now seeking for myself.
Rick, I sincerely hope this "very long thing" I've just written and the proposal which concludes it, bring no offense to you. Patriots have two things in common beyond their beliefs: First, we're a rare and widely dispersed species, which makes it tough for each of us to find trusty like-minded friends locally. Second, we're often fighting tigers that "normal people" could never imagine and would never dare to look in the teeth. These facts often leave us in the uncomfortable "spot" of having to reach out over long distances to find able allies and needed support. In reaching out to you today, I'm in no way making a demand or implying an expectation. I'm only struggling with all I've got--and that ain't much--to seek the means to keep on fighting for the right, in a way t hat will deliver as much present value to someone else as I'm now seeking for myself in support of pressing needs.
It would be so helpful if you could send me a response to all of this today, even if it's just a tentative thought or two. I MUST obtain a defense funded quickly--almost immediately--or we're likely to lose our truck, our computer, and our ESSENTIAL furniture and appliances, by operation of property seizure.
Having read all this, I hope you can understand the necessity for detailing our background and our dedication to restoring the American Republic. I felt it was important for you to know that we are not fair weather patriots, who are only looking for shelter now, because the "cold rain" of tyranny is suddenly pounding down on us. Further, I wanted you to know that we "may" have some resources of real value to share with you in your own immediate and long-term efforts to regain and maintain freedom for yourself, your family, and our nation.
Whatever you can or cannot do to help us now, please know Denille and I would be pleased to do whatever we can to help you presently, or at any time in the future.
